These Terms and Conditions govern your use of this website and the purchase of products from GARRISON TECHNOLOGY (PTY) LTD. (“we”, “us”, “our”). By using this website, creating an account, placing an order, or purchasing any product from us, you agree to these Terms and Conditions.

GARRISON TECHNOLOGY (PTY) LTD is the authorised distributor of PARD products in South Africa.

2. Application of these terms

These Terms and Conditions apply to all website visits, enquiries, quotations, orders, purchases, deliveries, collections, and related services provided by us.

By placing an order with us, you confirm that you have read and accepted these Terms and Conditions.

3. Product information

We make every reasonable effort to ensure that product descriptions, specifications, images, pricing, and availability are accurate.

However:

  • product images are for illustration purposes and may differ slightly from the actual product;
  • specifications, packaging, included accessories, and features may change without notice;
  • stock shown online may not always reflect live availability.

You are responsible for ensuring that the product you purchase is suitable for your intended use, unless you have expressly informed us of a particular purpose and relied on our recommendation.

4. Pricing

All prices are shown in South African Rand (ZAR).

Unless otherwise stated, public retail prices shown on the website include VAT at the prevailing rate.

Delivery charges, remote-area surcharges, insurance, special handling, and any optional extras are excluded unless clearly stated otherwise.

We reserve the right to change pricing at any time without notice, provided that no pricing change will affect an order already accepted by us.

If a genuine pricing, listing, or system error occurs, we reserve the right to cancel the order and refund any amount already paid.

5. Quotations

Any quotation issued by us is valid for the period stated on the quotation. If no validity period is stated, the quotation will be valid for 7 calendar days from the date of issue.

Quotations are subject to stock availability, supplier availability, exchange rate movement, and correction of any clerical or system error.

6. Orders and acceptance

Submitting an order on our website or accepting a quotation does not mean that the order has been accepted by us.

An order is only accepted once we have:

  • confirmed the order in writing;
  • issued an invoice;
  • allocated stock; or
  • dispatched the goods.

We reserve the right to refuse or cancel any order at our discretion, including where:

  • stock is unavailable;
  • payment cannot be verified;
  • a pricing or description error occurred;
  • fraud or unlawful activity is suspected; or
  • the order breaches our sales policies.

If an order is cancelled after payment has been received, we will refund the amount received in accordance with applicable law.

7. Payment terms

We may accept payment by EFT, card, payment gateway, or any other payment method made available on the website or by quotation.

For EFT payments:

  • stock is not reserved until cleared funds reflect in our bank account, unless we confirm otherwise in writing;
  • proof of payment does not count as confirmation of cleared payment;
  • we may delay dispatch until payment has cleared.

For card or gateway payments, transaction authorisation does not automatically mean that the order has been accepted.

We reserve the right to request identity verification, proof of address, or any other reasonable supporting documents before releasing goods.

8. Dealer and trade accounts

If you are approved as a dealer, reseller, or trade customer, separate pricing or account rules may apply.

Dealer pricing, dealer access, and trade terms are granted at our discretion and may be suspended or removed if:

  • payment terms are breached;
  • the account is misused;
  • products are resold in an unauthorised manner; or
  • the account no longer meets our dealer requirements.

Unless otherwise agreed in writing, dealer orders may be processed on an EFT payment basis.

9. Availability and stock

All products are sold subject to availability.

We reserve the right to limit quantities per customer or per order.

If stock becomes unavailable after an order is placed, we may:

  • offer an alternative product;
  • place the item on back-order; or
  • cancel the order and refund any amount paid.

Estimated lead times for back-order or special-order products are approximate only and not guaranteed.

10. Delivery and collection

We deliver within South Africa unless otherwise agreed in writing.

Delivery times provided by us are estimates only and are not guaranteed.

Delays may occur due to stock availability, supplier delays, courier delays, remote-area routing, weather, payment verification, or other circumstances beyond our control.

You are responsible for ensuring that the delivery address and contact information provided are accurate.

Additional delivery charges may apply for outlying areas, remote areas, high-risk areas, insurance, oversized shipments, or special handling requirements.

If delivery cannot be completed due to incorrect information, refusal, absence, or restricted access, additional delivery or return charges may apply.

Where collection is arranged, we may require proof of identity and proof of order before releasing the goods.

11. Risk and ownership

Ownership of the goods remains with us until full payment has been received in cleared funds.

Risk in the goods passes to you on delivery, collection, or handover to your nominated carrier, whichever occurs first.

If you arrange your own courier or collection, risk passes to you once the goods are handed to your representative or carrier.

12. Inspection on delivery

You must inspect the goods as soon as reasonably possible after delivery or collection.

Any visible damage, shortages, incorrect items, or signs of tampering must be reported to us in writing within 48 hours of delivery or collection.

This clause is intended to help us investigate delivery-related issues quickly, but it does not remove any rights you may have under applicable law.

13. Returns

Returns are subject to applicable South African consumer law.

If you believe goods are defective, damaged, incorrect, or not of the expected standard, you must notify us as soon as possible with your order number, a description of the issue, and supporting photos where applicable.

We may inspect, test, or assess returned goods before approving a repair, replacement, refund, or exchange.

We may refuse a discretionary return, or charge a reasonable handling or restocking fee where permitted by law, where goods have been:

  • misused;
  • damaged after delivery;
  • altered, modified, opened, mounted, installed, or tampered with;
  • used contrary to product instructions; or
  • returned incomplete or without all supplied parts and accessories.

Goods that are specially ordered, customised, imported on request, or supplied specifically for a customer may not be eligible for return unless required by law.

Nothing in these Terms limits any rights you may have under the Consumer Protection Act.

14. Defective goods, warranty, and repairs

Nothing in these Terms excludes or limits any rights that cannot lawfully be excluded, including any rights under the Consumer Protection Act.

As the authorised PARD distributor in South Africa, we handle qualifying warranty support, product assessment, and repair coordination in South Africa for products purchased through our authorised South African sales channels, dealers, or resellers, subject to applicable warranty terms and proof of purchase.

Qualifying products may carry a supplier warranty, manufacturer warranty, or both, depending on the product and the applicable warranty terms.

If you believe a product is defective or has developed a fault, you must notify us as soon as reasonably possible with your proof of purchase, serial number where applicable, a description of the issue, and any supporting photos or videos reasonably required for assessment.

We may inspect, test, assess, repair, replace, or refer the product through our South African warranty and service process before approving a refund, replacement, repair, or any other remedy, subject to applicable law.

Warranty support may be limited, declined, or charged for where the issue is found to arise from:

  • misuse, abuse, or neglect;
  • accidental damage;
  • cosmetic wear and tear;
  • incorrect installation, mounting, setup, or power supply;
  • unauthorised repair, opening, alteration, or modification;
  • improper storage, transport, impact, or water ingress beyond the product’s rating;
  • normal wear to consumables, batteries, chargers, accessories, or non-defective parts;
  • products not purchased through authorised South African sales channels, where local distributor warranty support does not apply.

If a product is returned and found not to have a covered defect, you may be responsible for reasonable inspection, shipping, repair, parts, or labour charges.

Nothing in this clause limits any statutory rights you may have under South African consumer law.

15. Special-order products

Products specially sourced, imported on request, configured to customer specification, or supplied on a special-order basis may require a deposit or full upfront payment.

Deposits paid for special-order products may be non-refundable, except where required otherwise by law or where we are unable to supply the product within a reasonable time and no suitable alternative is accepted.

16. Promotions and discounts

Promotions, coupons, launch offers, bundled products, and discounts are only valid while advertised and subject to stock availability.

Promotions may not be combined unless expressly stated.

We reserve the right to cancel or reverse any promotional benefit where fraud, abuse, or a clear system error occurred.

If a product purchased with a free gift or bundled item is returned, the bundled item may also need to be returned.

17. Use of products

You are responsible for ensuring that any product purchased from us is used lawfully, safely, and in accordance with the manufacturer’s instructions.

You are also responsible for ensuring that the product is suitable for your intended purpose, equipment setup, and use case.

We do not guarantee that any product is lawful for every possible use, application, territory, or regulated purpose. You must ensure your own compliance with any laws, regulations, or operational requirements that apply to you.

18. Website use

You agree to use this website only for lawful purposes.

You may not:

  • use the website fraudulently or unlawfully;
  • interfere with the website’s operation or security;
  • attempt unauthorised access to any part of the website or its systems;
  • submit false, misleading, or unauthorised orders; or
  • copy, reproduce, or exploit website content without permission.

We reserve the right to suspend access or cancel accounts where misuse is suspected.

19. Intellectual property

All content on this website, including logos, branding, text, product descriptions, graphics, images, layout, and design elements, remains our property or that of our licensors and suppliers.

You may not copy, reproduce, distribute, publish, or use any website content without prior written permission.

20. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss arising from the use of this website, the use of any product, or any delay or failure in performance.

This includes, without limitation, loss of income, loss of profit, loss of opportunity, loss of use, loss of data, or third-party claims.

Our total liability in relation to any claim arising from any product or order shall not exceed the amount paid by you for the product giving rise to the claim.

Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under South African law.

21. Indemnity

You agree to indemnify and hold us harmless against any loss, damage, liability, cost, or expense arising from:

  • your misuse of the website;
  • your unlawful or negligent use of products purchased from us;
  • your breach of these Terms and Conditions; or
  • your violation of any law or third-party rights.

This clause applies only to the extent permitted by law.

22. Force majeure

We will not be liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including but not limited to supplier delays, courier delays, import delays, power outages, network failures, labour disruption, weather events, civil unrest, government action, or other force majeure events.

23. Privacy

Your privacy is important to us.

Our collection, use, storage, and processing of personal information is governed by our Privacy Policy, which is available separately on this website.

By using this website or placing an order, you acknowledge that your personal information may be processed as described in that policy.

24. Complaints

If you have a complaint relating to an order, product, delivery, or service, you should contact us first using the contact details listed above so that we can attempt to resolve the matter directly. If a complaint cannot be resolved internally, you may have access to other remedies available under applicable South African consumer law.

25. Governing law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising in relation to these Terms, the website, or any sale transaction will be subject to the jurisdiction of the South African courts, subject to any rights you may have under applicable consumer law.

26. Changes to these terms

We reserve the right to update or amend these Terms and Conditions from time to time.

Any changes will apply from the date they are published on this website.

It is your responsibility to review the Terms and Conditions periodically.

27. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
